Marketplace Seller Terms
These Seller Terms supplement the General Terms, Acceptable Use Policy, Delivery Policy, Cancellation and Refund Policy, Privacy Policy and Commercial Eligibility rules. By applying for, opening or operating a seller account, you agree to comply with all applicable requirements.
1. Seller status
Unless VoxFati expressly states that it is the seller of a product, a Marketplace Seller acts as an independent trader or business in relation to the products it offers. The Seller is responsible for the legal relationship with the buyer, the accuracy of its listings, the products it supplies and the consumer obligations that apply to those transactions.
Nothing in these Seller Terms creates employment, agency, partnership or a franchise relationship between VoxFati and the Seller. The Seller must not claim to represent VoxFati or bind VoxFati to obligations unless expressly authorised in writing.
2. Eligibility and verification
A Seller must be legally capable of carrying on the relevant business and must provide accurate identity, business, tax, address, bank, payment-account and other onboarding information. VoxFati or its payment provider may require additional verification before listings are published or payouts are enabled.
The Seller must promptly update material information that changes and must maintain any licence, registration, insurance or authorisation required for the products it sells.
3. Product categories
Subject to applicable law, payment-provider support and category rules, the Marketplace may include handmade or designed goods, personalised products, vintage items, antiques, art, prints, books, stationery, jewellery, accessories, clothing, fashion, beauty and grooming products, craft materials, sewing supplies, home and living products, décor, gifts, hobby products, toys, pet accessories, wedding and event products, collectibles, coins, banknotes, medals, minerals, crystals, educational materials, digital downloads and other lawful specialty or lifestyle goods approved by VoxFati.
Approval of a category does not mean that every item within that category is permitted. VoxFati may apply additional requirements based on age restrictions, product safety, ingredients, provenance, export controls, consumer law, insurance, payment-provider rules or other risk factors.
4. Listing quality and accuracy
Listings must accurately identify the product, its condition, material characteristics, dimensions where relevant, price, included items, personalisation options, compatibility, delivery method and any material limitation a buyer would reasonably need to know before purchase.
Photographs must fairly represent the item being sold or, where representative images are used for made-to-order goods, must make that clear. Sellers must not use misleading images, hidden fees, false scarcity, fabricated reviews, keyword stuffing, false reference prices or deceptive claims about authenticity, origin, rarity, value or performance.
5. Authenticity, provenance and intellectual property
The Seller must have the legal right to sell every product and to use all listing content. Counterfeit goods, stolen goods, unauthorised reproductions, pirated digital files and products that unlawfully infringe copyright, trademark, design, patent or other rights are prohibited.
For antiques, coins, banknotes, medals, historical items, minerals, artwork or other items where provenance materially affects legality or value, the Seller must not fabricate provenance or attribution and must disclose material uncertainty. Where export, cultural-property, sanctions or heritage rules apply, the Seller is responsible for compliance and appropriate records.
6. Prohibited and restricted products
Sellers must not list illegal goods, stolen or counterfeit goods, prohibited weapons or explosives, unlawfully supplied drugs or prescription medicines, pornography or sexual services, gambling services, malware, fraudulent documents, unlawful surveillance products, sanctioned goods, unlawfully traded wildlife products, human remains, unlawfully traded cultural property or other items prohibited by the Acceptable Use Policy.
VoxFati may also restrict regulated health products, supplements, cosmetics, high-risk products, age-restricted goods, historical artefacts, precious materials or other categories that require additional compliance or are not supported by the relevant payment provider.
7. Product safety, instructions and warnings
The Seller is responsible for ensuring that products are safe, compliant and properly labelled for the countries in which they are sold. Where applicable, the Seller must provide ingredient information, safety instructions, age restrictions, electrical or product conformity information, allergen warnings, hazard notices and other legally required information.
Products must not be expired, contaminated, recalled, materially damaged in a way that creates a safety risk or supplied in breach of applicable product-safety law. If the Seller becomes aware of a material safety issue after sale, it must cooperate promptly with any recall, customer communication or corrective action required by law or VoxFati.
8. Beauty, cosmetics and personal-care goods
Beauty, cosmetic, grooming and personal-care products must comply with applicable ingredient, labelling, safety, notification and claims rules. The Seller must not market a cosmetic as diagnosing, treating or curing disease unless the product is lawfully authorised for that purpose.
Used or opened products may be prohibited where hygiene or safety cannot be assured. The Seller is responsible for clearly stating any lawful hygiene-related return restriction before purchase.
9. Digital products
Digital products must be described accurately, function as stated and include clear information about file type, access method, compatibility, licence scope and any technical requirements. The Seller must have the right to distribute every included file, font, image, template, recording or other protected work.
Unless a listing clearly grants broader rights, a digital purchase is licensed for the purchaser's personal use only and does not transfer ownership of the underlying intellectual property. The Seller must state any commercial-use licence separately and accurately.
10. Health, wellbeing, spiritual and performance claims
Product descriptions may refer to tradition, symbolism, personal practice, aesthetic qualities, sensory characteristics or customary uses where stated responsibly. Sellers must not guarantee medical, psychological, fertility, relationship, financial or supernatural outcomes and must not describe an unapproved product as diagnosing, treating, curing or preventing disease.
Testimonials and personal experiences must not be presented as proof that another buyer will obtain the same result.
11. Pricing and taxes
Prices must be genuine, clear and inclusive of mandatory charges where required by law. Sellers must not add undisclosed mandatory fees after checkout or manipulate reference prices to create a false discount.
The Seller is responsible for taxes, customs duties, registrations and regulatory charges that apply to its business or products unless VoxFati or a payment provider is legally required to calculate, collect or remit them.
12. VoxFati fees and commission
Marketplace setup charges, subscriptions, commissions, processing charges or other platform fees are governed by the commercial terms displayed during Seller onboarding or in the Seller dashboard. Those amounts may change prospectively in accordance with the applicable agreement and any legally required notice.
The Seller must not attempt to avoid an applicable VoxFati fee by using listings, messages, invoices or other platform features to divert a transaction off-platform where the transaction originated through VoxFati and fee avoidance is prohibited by the applicable commercial terms.
13. Payment accounts and payment-provider rules
The Seller may be required to establish and maintain an eligible connected payment account. The payment provider may conduct identity, fraud, sanctions and business-category checks and may independently refuse, limit or suspend payment services.
The Seller must not use VoxFati or a connected payment account for a category prohibited by the payment provider. If a payment provider requests information relating to a Seller's activity, the Seller must cooperate reasonably and provide accurate information.
14. Orders and availability
The Seller must maintain reasonably accurate stock or availability information and must fulfil accepted orders within the stated processing time. If an item is unavailable, cannot lawfully be shipped or was materially mispriced, the Seller must notify the buyer promptly and provide the remedy required by law or VoxFati policy.
A Seller must not cancel orders selectively for discriminatory or retaliatory reasons or use repeated cancellations to manipulate marketplace performance.
15. Fulfilment, shipping and tracking
The Seller is responsible for packaging, dispatch, shipping, customs documentation and delivery obligations for physical goods. Delivery estimates must be realistic and any material delivery restriction must be disclosed before purchase.
Where tracking is available or required by VoxFati, the Seller must provide accurate tracking information. Sellers must not submit false tracking numbers or mark an order as dispatched before the parcel has genuinely entered the fulfilment process.
16. Returns, cancellations and consumer rights
The Seller must maintain return and cancellation terms that comply with applicable consumer law. Where a buyer has a statutory right to cancel a distance sale, return faulty goods or obtain another remedy, the Seller must not contract out of that right.
Personalised goods, hygiene-sensitive products, digital content and services may be subject to different cancellation rules. Any lawful exception must be disclosed clearly before purchase and applied consistently with the Cancellation and Refund Policy.
17. Buyer support and disputes
Sellers must respond to reasonable buyer questions and complaints within a reasonable period and cooperate with VoxFati where a case, refund, chargeback, fraud report or delivery dispute is investigated. A Seller must not threaten, harass or retaliate against a buyer for making a complaint or leaving a lawful review.
18. Buyer data and privacy
Buyer information supplied through VoxFati may be used only for legitimate order fulfilment, customer support, legal, tax, accounting or other authorised purposes. Sellers must not add buyers to marketing lists, sell their information or use order details for unrelated solicitation without a lawful basis.
Where the Seller acts as an independent data controller, it is responsible for complying with applicable data-protection law and for securing the personal information it receives.
19. Reviews and marketplace integrity
Sellers must not create fake orders or reviews, purchase reviews, offer undisclosed rewards for positive reviews, require a customer to remove criticism as a condition of receiving a legal remedy or coordinate review manipulation.
Sellers may respond to reviews professionally and may report content that genuinely violates VoxFati rules.
20. Insurance and regulatory responsibility
Where appropriate to the product or business, VoxFati may require proof of product liability insurance, professional insurance, business registration, safety certification or other compliance documentation. The Seller remains responsible for deciding what insurance and regulatory approvals its business requires.
21. Payouts, reserves and holds
Payout timing may depend on payment-provider settlement, chargebacks, refunds, account verification, reserves, fraud controls and applicable law. VoxFati does not guarantee that funds will be available before they have been received and cleared through the relevant payment arrangements.
Where legally and contractually permitted, payouts may be delayed or placed on review where there is a credible fraud, chargeback, sanctions, compliance or non-delivery risk.
22. Listing review and enforcement
VoxFati may request edits, evidence, provenance, safety information or verification; reject or remove a listing; restrict a category; pause sales; suspend a Seller account; or terminate Marketplace access where reasonably necessary to enforce these Terms, protect buyers, comply with law or meet payment-provider requirements.
Where appropriate, VoxFati may take account of the seriousness and frequency of the issue, the Seller's cooperation, buyer impact and whether corrective action is sufficient.
23. Seller responsibility and indemnity
To the extent permitted by law, the Seller is responsible for claims, losses, penalties, chargebacks, recalls, taxes, costs and reasonable legal expenses arising from its unsafe or unlawful products, false descriptions, infringement, consumer-law breaches, tax failures, privacy violations or material breach of these Seller Terms, except to the extent caused by VoxFati's own breach or negligence.
24. Suspension and termination
Marketplace access may be suspended or terminated for serious or repeated policy breaches, fraud, non-payment, chargeback abuse, unsafe products, counterfeit goods, sanctions risk, abusive conduct, payment-provider requirements or other material breach. Outstanding buyer obligations, refunds, disputes and legal record-keeping duties continue after termination.
25. Changes
VoxFati may update these Seller Terms to reflect changes in law, consumer rules, product categories, payments, safety standards or Marketplace operations. Material changes affecting an ongoing paid Seller relationship will be communicated where required by law or contract.
